These Terms govern your use of Bay Area Swim (the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Data accuracy
Bay Area Swim aggregates water-quality, bacteria sampling, and precipitation data from public sources. Sampling frequency varies by agency, and reported data may be delayed, incomplete, or inaccurate. Water conditions at any given swim spot can change rapidly — often faster than sampling cadence can detect.
Always check the official posting at the swim spot and with the responsible agency (for example SFDPH, EBMUD, EBRPD, or State Parks) before entering the water. Swim at your own risk.
Not medical advice
The information on this Site is provided for general informational purposes only. It is not medical advice and is not a substitute for consultation with a qualified health professional. Do not rely on the Site for decisions about health, illness, or exposure to contaminated water.
No warranty
The Site is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or availability. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, in no event shall Bay Area Swim, its maintainer, contributors, or data providers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or injury, arising out of or related to your use of or inability to use the Site, whether based in contract, tort (including negligence), strict liability, or any other theory, even if advised of the possibility of such damages. To the maximum extent permitted by law, your sole and exclusive remedy for any dissatisfaction with the Site is to stop using it.
Third-party content
The Site links to and displays attribution for data from third parties (see the Data Sources page). We do not control those sources and are not responsible for their accuracy or availability.
Acceptable use
Do not attempt to disrupt or overload the Site, scrape at abusive rates, or use the Site for any unlawful purpose.
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You agree that any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in California.
Changes
We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
